Escorted into the courtroom wearing shackles around his wrists, Tribble represented himself at Monday's hearing without his standby counsel, defense attorney Dan Sedon, who could not attend.
Water damaged evidenceBefore the hearing began, Tribble asked to view evidence that might have been damaged by a leak in the Lamoille County Courthouse's basement vault, where Page said evidence is stored.
State prosecutors Joel Page and Christopher Moll requested that these documents be viewed by Judge James Crucitti privately. Crucitti took most of these motions under advisement, ruling on only one: that the court would not allow the jury to hear about Borello's and Tribble's character traits unless Tribble opens the discussion by claiming that he acted in self defense.
Tribble attended his second trial in 2009, when he was convicted of second degree murder. The high court overturned this verdict, too, ruling that the lower court mistakenly allowed the jury to hear videotaped testimony about Tribble's mental state at the time of the shooting.
Tribble fired three court appointed attorneys before his first trial, but refused to represent himself. Tribble fired his third attorney the day before the trial and then boycotted the proceedings after the judge declined to appoint a new defense lawyer. Jurors convicted the defendant of first degree murder, but the Vermont Supreme Court later overturned the verdict, ruling that the lower court improperly allowed the trial to proceed without the defendant.
